In January of last year, a homeless man named Dumisani Joxo was shot and killed by a law enforcement officer named Luvolwethu Kati in Rondebosch, Cape Town. The incident occurred after an alleged argument between Kati and another homeless man, Linda Mbuqe. Recent testimonies suggest that Kati fired the lethal shot without warning.
During a recent court hearing, 19-year-old Dylan-Leigh Coleridge testified that he witnessed the tense altercation between Kati and Mbuqe, which ultimately led to Joxo’s death. Coleridge described seeing Kati draw his firearm, prompting Mbuqe to pick up a pickaxe. Kati allegedly threatened to shoot Mbuqe if he attacked him with the pickaxe. The argument escalated after Kati kicked over the pot of boiling water, causing a scene of heightened tension.
As the altercation continued, Joxo, who had been asleep in a nearby tent, awoke and attempted to exit the tent. According to Coleridge, Joxo appeared relaxed and seemed as though he merely wanted to walk past the scene. However, Kati reportedly pushed Joxo and fired the fatal shot without any warning.
Kati’s attorney, John Riley, cross-examined Coleridge and questioned his account of the events. Riley pointed out inconsistencies with previous testimonies and potential language barriers. Coleridge maintained that he had witnessed Kati draw his firearm when Mbuqe refused to douse the fire, leading to Mbuqe fetching the pickaxe.
Riley also highlighted conflicting accounts of Joxo’s demeanor during the incident. While Coleridge’s mother had previously testified that Joxo was upset after being pushed, Coleridge contradicted this by saying Joxo appeared to want to walk past the argument.
Riley argued that Kati fired the shot in self-defense, as both Joxo and Mbuqe were allegedly attacking him and threatening to take his firearm. Coleridge, however, denied this claim. The case, which has captured the attention of the local community, is set to continue on August 8th.
This tragic event highlights the complex and fraught interactions between law enforcement and the homeless community. While it remains unclear what led Kati to fire the fatal shot, the case serves as a powerful reminder of the need for empathy, understanding, and effective communication when dealing with vulnerable populations.
