Police Constable Imprisoned for Rape after IPID Investigation

The Independent Police Investigative Directorate (IPID) in Gauteng investigated a case of kidnapping and rape involving two police constables attached to the Springs police station in Ekurhuleni, Gauteng. The incident occurred on August 21, 2016, when the constables took a 43-year-old female complainant with them to the police station while attending to a disturbance complaint.

The Shocking Crime

During her return home, the victim was subjected to the heinous crime of rape. The two accused constables, Jabulani Raymond Nkwinika and Nkopodi Alex Kgalema, were charged with kidnapping and rape.

The Legal Proceedings

After years of legal proceedings, on March 28, 2023, 39-year-old Nkwinika was acquitted of all charges. However, 44-year-old Kgalema was acquitted of kidnapping but convicted of rape. Springs Regional Court sentenced Constable Kgalema to 10 years’ imprisonment for rape on June 19, 2023. Additionally, he was declared unfit to possess a firearm.

IPID’s Role

IPID National Spokesperson Robbie Raburabu confirmed that both members had previously been acquitted in an internal disciplinary hearing in 2017 regarding the same matter, following an IPID recommendation for the hearing.

This case highlights the crucial role of IPID in holding law enforcement officers accountable for their actions. The IPID’s diligence in pursuing this case ensures that those who abuse their power and authority are brought to justice.
