The recent ruling by the Supreme Court of Appeal (SCA) sheds light on the controversy surrounding the electrification of several villages in Limpopo Province. This decision marks a significant milestone in the fight against corruption and maladministration in South Africa.
Mphaphuli Consulting, an engineering company owned by Lufuno Mphaphuli, found itself embroiled in a scandal following an investigation report by the Special Investigating Unit (SIU) concerning the electrification of villages under the Greater Tubatse Municipality. The crux of the issue was the Greater Tubatse Municipality’s piggybacking on an existing contract between Mphaphuli Consulting and Vhembe District Municipality.
The SCA dismissed Mphaphuli’s attempt to appeal the Limpopo High Court’s judgment on the investigation report, bringing a sense of satisfaction and vindication for the SIU. The ruling confirmed the SIU’s authority to investigate corruption and maladministration, paving the way for the recovery of approximately R76 million through a civil claim against Mphaphuli Consulting.
Authorized under Proclamation R52 of 2014, the SIU’s mandate is to investigate allegations of corruption and maladministration within the Greater Tubatse Local Municipality, now called Fetakgomo Tubatse. The SIU may institute civil action in the High Court or a Special Tribunal in its name to rectify any wrongdoing uncovered during its investigations, caused by acts of corruption, fraud, or maladministration. Any evidence of criminal conduct is referred to the National Prosecuting Authority (NPA) for further action.
