Maintaining Impoundments for Commuter Safety
The court’s ruling affirms that impoundments will continue under the National Land Transport Act to promote commuter safety. The Taxi Task Team, consisting of SANTACO representatives, the City of Cape Town, and the Western Cape Government, will focus on regulating impoundable offenses that endanger road users’ lives.
Collaboration for Progress
Councillor Rob Quintas recognizes the vital role the minibus-taxi industry plays in Cape Town’s public transport network and believes that collaboration and open dialogue are essential to address the challenges faced by the industry and government. The Task Team will convene on 22 August 2023 to work on resolving these issues.
Court-Ordered Agreement
The court-ordered agreement, effective from 14 August 2023, includes several critical points. First, the Task Team will seek consensus on offenses that directly threaten commuter safety and warrant impoundment. This consultation will inform a Standard Operating Procedure (SOP) to guide enforcement personnel’s actions.
Second, impoundments will continue for vehicles operating without valid licenses or permits or those deemed road-unworthy. SANTACO may submit cases of vehicles allegedly impounded for minor offenses that do not impact commuter safety, and if the City agrees, they will make representations for the release of these vehicles.
Lastly, the agreement establishes strike protocols and resolution measures. SANTACO commits to providing at least 36 hours’ notice before initiating future strike actions and includes a dispute escalation and resolution clause.
