Encouraging Western Cape Housing Beneficiaries to Draft Wills During National Wills Week

In an effort to promote the security of tenure and prevent property disputes among family members, the Western Cape Department of Infrastructure encourages all housing beneficiaries to draft their wills during National Wills Week. This annual event provides an opportunity for attorneys to offer free basic will drafting services to citizens.

Importance of Drafting a Will

Jacqueline Gooch, Head of the Infrastructure Department, emphasizes the significance of having a valid will. Without a will, disputes may arise among family members, leading to delays, emotional distress, and undesirable outcomes. The department cannot intervene in the allocation of a house after the initial handover, making it crucial for beneficiaries to designate ownership in the event of their death.

Potential Consequences of Not Having a Will

The absence of a will may result in a loss of control over property distribution, leaving unmarried partners with nothing, and disagreements among family members. Additionally, the winding-up process for the estate could take years, causing further distress to loved ones.

To facilitate a smoother transfer of property ownership and prevent difficult situations, Western Cape residents are encouraged to take advantage of National Wills Week. The department aims to empower housing beneficiaries to make informed decisions and offer peace of mind to their loved ones.

Seeking Assistance from Attorneys

While drafting one’s own will is an option, seeking assistance from an attorney or financial advisor is recommended. The Law Society of South Africa provides a list of participating Western Cape attorneys for citizens to contact.

Western Cape Minister of Infrastructure, Tertuis Simmers, asserts that educating citizens on the significance of a will is an absolute necessity, as the well-being of households without a will remains at risk of losing their accumulated assets. Through these efforts, the department hopes to provide a valuable service to its beneficiaries, ensuring the proper management of housing assets for future generations.
