Investigating Allegations of Maladministration in KwaZulu Natal’s Office of the Premier

The Special Investigating Unit (SIU) has been authorized by President Cyril Ramaphosa to investigate allegations of maladministration in the Office of the Premier in KwaZulu Natal. The investigation will focus on the appointment of a consultant supporting six provincial priority programs, including the Luwamba Wellness Centre Project and Operation Sukuma Sakhe Projects.

Examining Expenditures and Losses

The SIU’s mandate is to determine whether any unauthorized, irregular, or fruitless and wasteful expenditure occurred within the Office of the Premier in KZN. The investigation will also examine any losses suffered by the Provincial Office or the State. The SIU will leave no stone unturned and will work diligently to uncover any irregular, improper, or unlawful conduct by contractors, employees, officials of the Office of the Premier, and suppliers, service providers, or other individuals or entities.

Preventing Future Losses

The investigation is not limited to uncovering maladministration and malpractice. The SIU will also identify failures and provide systematic recommendations to implement preventive measures against future losses. The Proclamation covers allegations of unlawful and improper conduct that took place between 1 April 2007 and 29 July 2023, as well as instances that occurred before or after these dates that are relevant to the investigation.

Taking Action Against Wrongdoing

The Special Investigating Units and Special Tribunals Act 74 of 1996 grants the SIU the authority to institute civil action in the High Court or a Special Tribunal, correcting any wrongdoing discovered during its investigations. This is particularly crucial when dealing with acts of corruption, fraud, or maladministration. Furthermore, any uncovered evidence pointing to criminal conduct will be referred to the National Prosecuting Authority (NPA) for further action.
