The Madadeni Regional Court in Newcastle, South Africa, has set a significant precedent in protecting women and children from sexual violence by handing down a groundbreaking decision. On May 4, 2023, the court sentenced Muziwami Zwane, a 45-year-old man, to three life imprisonment terms for raping three women in separate incidents in November 2019. Additionally, he received nine years for kidnapping and six years for assault with the intent to cause grievous bodily harm. The court’s landmark ruling emphasizes that such heinous crimes will not be tolerated, and that the justice system stands firmly behind the victims.
The First Case
Zwane’s actions began on November 2, 2019, when he lured a 40-year-old woman from a tavern to his home in Section 2, Madadeni. Once inside, he locked the door, dragged her to his bedroom, and subjected her to repeated rape. The victim remained imprisoned for three days before managing to escape. The following day, Zwane convinced his ex-girlfriend to visit him under the guise of sharing traditional beer. The then 27-year-old woman experienced a similar fate – kidnapping, repeated rape, strangulation, and assault with a bush knife. Earlier in the year, Zwane had employed the same nefarious tactics to kidnap, assault, and rape a 29-year-old woman over two days.
The Second Case
The Madadeni Regional Court sentenced Mandlenkosi Ace Jiyane, a 46-year-old man, to life imprisonment on May 5, 2023, for raping a 12-year-old girl in Madadeni’s Section 3 on October 19, 2020. The child’s teacher noticed something was amiss and, in collaboration with her parents, prompted the girl to disclose her harrowing ordeal at Jiyane’s hands. Following his arrest, his name will now appear on the National Register of Sex Offenders.
The Commendation of the Investigating Officers
The Provincial Commissioner of KwaZulu-Natal, Lieutenant General Nhlanhla Mkhwanazi, commended the Family Violence, Child Protection, and Sexual Offences (FCS) investigating officers for their diligent work in securing these vital convictions. He emphasized that rapists have no place in society and law enforcement will tirelessly work to prevent these crimes. He further emphasized that in the unfortunate event of a rape, dedicated investigators will ensure that victims receive justice, and perpetrators face the full extent of the law.
