Legal Challenges Hamper Fort Hare University Investigation

The Special Investigating Unit (SIU) is currently investigating allegations of maladministration within Fort Hare University, South Africa. However, legal challenges have arisen that impact the SIU’s ability to carry out its investigation, particularly because the allegations involve Eastern Cape Premier Oscar Mabuyane.

Bisho High Court Order

On June 20, 2023, Judge T. V. Norman of the Bisho High Court issued an order regarding a case brought forth by Premier Mabuyane. The order prevents the SIU from enforcing Proclamation R 84 of 2022, which authorizes the Unit to investigate the allegations. This interim interdict is pending the determination of Part B, which examines the merits of the case, particularly in relation to a Masters degree’s admission and awarding.

SIU’s Optimism

Despite the legal challenges, the SIU remains optimistic about continuing their investigation when Part B of the case is heard. In particular, the paragraph 66 of the judgment is encouraging, stating that the SIU can prepare a motivation to investigate the Masters degree’s registration if there is evidence of unlawful conduct related to it. Additionally, paragraph 83 of the judgment notes that there is no evidence of malice on the SIU’s part.

Although the legal challenges have temporarily halted the investigation’s progress, the SIU notes that the judgment’s scope is limited. The final outcome of the investigation could significantly impact those involved, particularly Premier Mabuyane, who holds a prominent position in South African politics.
